Captain Services Agreement

THIS CAPTAIN SERVICES AGREEMENT (this “Agreement”) is made as of the date above by and between Name above, individually (the “Charterer”) and Captain choosen below, a USCG licensed captain, Ref#8471546, (the “Captain”) and, individually (the “Crew”). If crew has been assigned by the Captain.

1. The Captain and Crew shall have sole authority and responsibility for the safe navigation and safety of the Vessel.

2. The Captain and Crew shall preform assigned duties on the vessel in a timely, neat, first class, good and workmanlike manner, in strict compliance with the laws of the United States of America and in accordance with all rules and regulations that may be applicable to this agreement and the performance of said duties. The Captain will have the final decision on the safe operation of vessel.

3. The Captain and Crew have the power and authority to report any illegal drugs or drug use on board to the proper authorities and make arrangements for the Vessel to be met at dock. The Captain also has the right to terminate the charter at any time for improper, abusive, or dangerous behavior on board.

4. Captain and Crew’s relationship to the Charterer shall be that of an independent contractor and not of an employee or agent of the Charterer or the owner of the Vessel. The Captain and Crew have discretion as to how to perform the services contemplated by this Agreement. The Captain’s appointment was freely made by the Charterer, having been presented with options from the owner of the vessel or third party booking agent.

I agree to the terms of the Waiver and Release of liability policy found at the link below (View terms of use). I hereby release for myself, my heirs, executors, administrators, assigns, or personal representatives knowingly and voluntarily enter into this WAIVER and RELASE OF LIAILITY and hereby waive any and all rights, claims or causes of action of any kind arising out of my participation in the activity; and I HEREBY release and forever discharge COVE Cay Charters located at 2519 N McMullen booth rd., Clearwater, FL 33761 Its Captains including but not limited to Jeremy Ritchea, their Affiliates including but not limited to Cove Cay Marina, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors, and assigns (collectively "Releases"), from any physical or psychological injury that I may suffer as a direct result of my participation in the aforementioned Activity. If I added in minors to this form I certify that I am the parent or legal guardian of those children and take full responsibility legally and finicallyView terms of use

Photograph and Publicity Release Policy I give the Cove Cay Charters and its Captains including but not limited to Capt. Jeremy Ritchea, permission to use my name, likeness, image, voice, and/or appearance as such may be embodied in any pictures, photos, video recordings, audiotapes, digital images, and the like, taken or made on behalf of the Cove Cay Charters activities. I agree that the Cove Cay Charters and its Captains have complete ownership of such pictures, etc., including the entire copyright, and may use them for any purpose consistent with Cove Cay Charters activates. These uses include, but are not limited to illustrations, bulletins, exhibitions, videotapes, reprints, reproductions, publications, advertisements, and any promotional or educational materials in any medium now known or later developed, including the Internet. I acknowledge that I will not receive any compensation, etc for the use of such pictures, etc., and hereby release Cove Cay Charters and its agents, Captains and assigns from any and all claims which arise out of or are in any way connected with such use.
